1. Acceptance of Terms
By accessing, registering an account, or participating in any activities on Swim360 (including the website swim360.org and mobile applications), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service.
If you register on behalf of a minor (under 18 years of age) for aquatic courses, you represent and warrant that you are their lawful parent or legal guardian and accept full responsibility for their medical readiness and safety supervision.
2. SwimPassport & Wearable Telemetry
Swim360 provides the Digital SwimPassport, empowering swimmers to synchronize verified telemetry workouts from smartwatch devices (Garmin, Apple Watch, etc.).
- Performance Metrics: Total distance, stroke counts, heart rate zones, and SWOLF scores are analyzed to personalize training curricula and issue cryptographically verifiable certificates.
- Telemetry Integrity: Fabricating GPS records or manipulating telemetry to illicitly claim community grants from the Swim to Give fund is strictly prohibited and subject to immediate account termination.
3. Escrow Vault & Tuition Protection
100% Tuition Protected in Independent Vault
When you complete course tuition on Swim360, your payment is held securely in an independent Escrow Vault. Coaches are paid incrementally session-by-session only after the student attends and verifies training quality on deck.
4. Cancellation & Refund Policy
Students retain the right to cancel or reschedule sessions under standardized guidelines:
Zero-Risk First Trial Session
If you feel the coach is not a good fit after lesson 1, you can request an immediate 100% refund of the remaining escrow balance with zero penalties.
12-Hour Rescheduling Notice
Trainees can reschedule a lesson without forfeiting their session balance if requested at least 12 hours in advance via the in-app chat.
5. Trainer Standards & Pool Safety
All certified trainers on the Swim360 platform must successfully pass credential identity verification (KYC), hold active aquatic rescue / CPR certification, and commit to strict child-safeguarding ethics.
6. Medical Readiness & Health Disclaimer
Swimming is a physically demanding whole-body sport. Every student is responsible for assessing their personal physical condition (including cardiovascular conditions, asthma, or inner ear disorders) and consulting medical professionals before starting intensive sets.
7. Governing Law & Dispute Resolution
Disputes arising from transactions shall first be arbitrated through Swim360 internal Escrow Resolution Board before referral to statutory commercial arbitration bodies in respective operational jurisdictions (Vietnam, Singapore, Thailand).
